Terms of Service
These Terms of Service govern your access to and use of the AfricanDrama Vault website, digital products, official merchandise, services and related features.
Effective and last updated: August 3, 20261. Acceptance of These Terms
These Terms of Service, together with our Privacy Policy, Return Policy, Shipping Policy and any other policies or notices displayed on the website, form a legally binding agreement between you and AfricanDrama Vault.
Throughout these Terms, the words “AfricanDrama Vault,” “we,” “us” and “our” refer to AfricanDrama Vault. The words “you” and “your” refer to the visitor, customer, purchaser, account holder or other person using our services.
By accessing the website or purchasing from us, you confirm that you have read, understood and agreed to these Terms. If you do not agree, you must not access or use the website or services.
2. Eligibility and Authority
You must be at least the age of legal majority in your place of residence to make a purchase or independently agree to these Terms. A minor may use the website only with the involvement and permission of a parent or legal guardian.
If you use the website on behalf of a business, organization or another person, you represent that you have authority to bind that party to these Terms.
3. Online Store Terms
Our online store is hosted through Shopify and may use additional service providers to support checkout, payment processing, digital delivery, production, fulfillment, analytics, communications and other store functions.
You may not use our products, website or services for any unlawful or unauthorized purpose. You must comply with all laws and regulations applicable to your use of the website and products.
A breach of these Terms may result in immediate suspension or termination of access to the website or services.
4. Account and Checkout Information
You agree to provide current, complete and accurate information when creating an account, joining a mailing list or completing a purchase.
You are responsible for maintaining the confidentiality of your account credentials and for activity conducted through your account. Notify us promptly if you believe your account or payment information has been used without authorization.
You are responsible for confirming that your email address, billing information and delivery address are accurate before submitting an order. We are not responsible for delays or losses caused by incorrect information supplied by the customer, except where applicable law requires otherwise.
5. Products, Services and Availability
We may offer digital story collections, educational resources, creator tools, templates, apparel, accessories, branded merchandise and other products or services.
Products and services may be available exclusively online and may have limited quantities or availability. We reserve the right to:
- Modify or discontinue a product or service;
- Limit sales by person, household, region or jurisdiction;
- Limit quantities available for purchase;
- Refuse or cancel an order where reasonably necessary;
- Correct descriptions, images, pricing or availability errors.
We make reasonable efforts to display products accurately. However, screen settings, garment materials, manufacturing processes and printing methods may cause minor variations in color, placement, dimensions or appearance.
6. Digital Products and Download Licenses
Digital products may include ebooks, story collections, worksheets, templates, guides, creator resources, downloadable documents and other electronic content.
Unless a product listing expressly provides different rights, your purchase gives you a limited, personal, non-exclusive, non-transferable and revocable license to access and use the digital product for your own lawful personal or internal business purposes. Ownership of the underlying content and intellectual property is not transferred to you.
You may not:
- Resell, redistribute, sublicense or share a digital product;
- Upload purchased files to public websites, groups, drives, marketplaces or file-sharing services;
- Copy or reproduce substantial portions for commercial distribution;
- Remove copyright, trademark or ownership notices;
- Claim our content, stories, templates or designs as your original work;
- Use the files to create a directly competing product for resale;
- Provide download access to individuals who did not purchase the applicable license.
Digital purchases are generally final once access or delivery has been provided, subject to applicable consumer-protection laws. If a file is inaccessible or technically defective, contact us so we can attempt to correct the issue.
7. Creator Tools and Educational Resources
Creator toolkits, templates, strategies, checklists, prompts and educational resources are supplied for informational and educational purposes only.
We do not guarantee views, followers, engagement, sales, income, platform approval, monetization eligibility or any particular business result. Outcomes depend on many factors outside our control, including your execution, audience, originality, market conditions and compliance with third-party platform rules.
Platform requirements may change at any time. You are responsible for reviewing and following the current rules of TikTok, YouTube, Instagram, Facebook, Shopify, Printify and any other platform you choose to use.
Our educational resources do not constitute legal, financial, tax, accounting or professional business advice.
8. Made-to-Order Merchandise
Certain physical products are manufactured or printed after an order is placed. These products may be fulfilled through Printify or other independent production partners.
Because made-to-order items are produced specifically for each customer, orders may enter production shortly after checkout. Changes to size, color, design, quantity or delivery address may not be possible after production begins.
Customers are responsible for reviewing product descriptions, sizing information and order details before completing checkout. Minor manufacturing, alignment or color variations that fall within reasonable production tolerances are not necessarily defects.
9. Orders, Acceptance and Cancellations
Submitting an order is an offer to purchase. An automated order confirmation acknowledges receipt but does not necessarily mean that we have accepted the order.
We reserve the right to reject, limit or cancel an order for reasons including:
- Suspected fraud, unauthorized activity or payment risk;
- Pricing, inventory or product-information errors;
- Product unavailability;
- Violation of these Terms;
- Orders that appear to be placed by resellers or distributors;
- Legal, geographic or fulfillment restrictions.
If we cancel an order after receiving payment, we will issue an appropriate refund to the original payment method, subject to payment-provider processing times.
Cancellation requests must be submitted as soon as possible. Cancellation is not guaranteed after a physical product enters production or after a digital product has been delivered.
10. Pricing, Billing and Payments
Prices are displayed in the currency shown at checkout and may change without prior notice. The price charged is the price shown when your order is submitted, subject to correction of obvious pricing or technical errors.
Taxes, shipping costs, customs charges and other applicable fees may be added during checkout or charged by government or delivery authorities.
By submitting payment information, you represent that you are authorized to use the selected payment method and authorize the applicable charges.
Payment information may be processed by Shopify Payments or other third-party payment providers. We do not control every aspect of third-party processing times, security reviews, authorizations, holds or declines.
11. Production, Shipping and Delivery
Physical products may require production time before shipment. Processing and delivery estimates are provided for convenience and are not guaranteed.
Delivery may be affected by production volume, carrier operations, weather, customs, holidays, address problems, international restrictions and other circumstances outside our reasonable control.
Items from the same order may be produced at different facilities and delivered in separate packages.
When tracking is available, it will normally be sent to the email address associated with the order. The customer is responsible for monitoring delivery and providing a secure delivery location.
Additional details are available in our Shipping Policy.
12. Returns, Refunds and Product Issues
Return, refund and replacement eligibility is governed by our applicable Return Policy and by mandatory consumer rights that cannot lawfully be excluded.
Because made-to-order products are created specifically for the customer, returns or exchanges based solely on selecting an incorrect size, color or style—or changing your mind—are generally not accepted.
If an item arrives damaged, materially defective or with a manufacturing error, contact us promptly and provide the order number, an explanation and clear photographs showing the entire product and the reported issue.
Do not return a product without receiving instructions from us. Unauthorized returns may not be accepted or refunded.
Digital products are generally non-returnable and non-refundable after delivery or access, except where required by law or when we determine that a qualifying technical problem cannot be corrected.
Read our complete Return and Refund Policy before purchasing.
13. Promotions, Discounts and Gift Offers
Promotional codes and special offers may be subject to separate conditions, expiration dates, product exclusions and usage limits. Unless expressly stated otherwise:
- Only one promotional code may be used per order;
- Discounts cannot be applied retroactively;
- Offers have no cash value;
- Offers may not be sold, copied or transferred;
- Shipping, taxes and fees may be excluded;
- We may cancel an offer affected by error, fraud or misuse.
14. Intellectual Property Rights
The website and its contents—including the AfricanDrama Vault name, logos, characters, stories, scripts, plotlines, artwork, graphics, photographs, videos, audio, designs, product names, page layouts, downloads, templates, text and other materials—are owned by or licensed to AfricanDrama Vault and are protected by applicable intellectual-property laws.
Except for the limited rights expressly granted in these Terms, no content may be copied, modified, republished, reproduced, displayed, distributed, sold, licensed, reverse engineered or commercially exploited without our prior written permission.
AfricanDrama Vault names, logos, slogans and visual branding may not be used in a manner that suggests sponsorship, endorsement, affiliation or authorization without written approval.
You may share links to publicly available pages for lawful, noncommercial purposes, provided that you do not misrepresent your relationship with AfricanDrama Vault.
15. Reviews, Comments and Other Submissions
You may be able to submit reviews, comments, photographs, messages, ideas, suggestions or other content.
You retain ownership of original content that you submit. However, by submitting content to us, you grant AfricanDrama Vault a non-exclusive, worldwide, royalty-free license to use, reproduce, display, format and distribute that content for operating, improving and promoting our business and services, subject to applicable privacy law.
You represent that:
- You own or have permission to submit the content;
- The content is truthful and based on genuine experience;
- The content does not violate another party’s rights;
- The content is not unlawful, defamatory, threatening, fraudulent, obscene, discriminatory or malicious;
- The content does not contain malware or harmful code.
We may monitor, refuse, edit or remove submissions when reasonably necessary, but we are not obligated to publish or retain every submission.
16. Prohibited Uses
You may not use the website, products or services to:
- Violate any law, regulation or third-party right;
- Commit fraud, impersonation or deceptive activity;
- Infringe copyrights, trademarks or other property rights;
- Harass, threaten, abuse, discriminate against or harm another person;
- Transmit malware, viruses or destructive code;
- Collect personal information without lawful authorization;
- Scrape, crawl, data-mine or automatically extract website content without written permission;
- Circumvent website security, access controls or purchase limits;
- Interfere with website performance or another user’s access;
- Use purchased content to create unauthorized competing products;
- Submit false payment disputes, chargebacks or product claims;
- Use the website for spam or unauthorized advertising.
We may suspend or terminate access and take appropriate legal action in response to prohibited conduct.
17. Third-Party Tools, Links and Services
The website may contain links to or integrations with third-party websites, platforms, payment providers, social networks, production partners or applications.
Third-party services are governed by their own terms and privacy practices. We do not control and are not responsible for the availability, content, security, products, practices or performance of independent third parties.
Your use of third-party services is at your own discretion and subject to the applicable third party’s terms. Review those terms before providing information or completing a transaction.
18. Privacy and Personal Information
Our collection, use and disclosure of personal information is described in our Privacy Policy.
Depending on your location, you may have additional privacy rights. Visit our Your Privacy Choices page to review available options and submit an applicable privacy request.
By using our services, you acknowledge that information may be processed by Shopify and other service providers that help us operate the store.
19. Disclaimers and No Warranties
To the maximum extent permitted by law, the website, services and products are provided on an “as is” and “as available” basis.
We do not warrant that:
- The website will always be available or uninterrupted;
- The website will be free from every error or security risk;
- All information will always be complete or current;
- Every product will meet subjective personal expectations;
- Creator resources will produce a particular result;
- Third-party platforms will approve or monetize your content.
To the fullest extent permitted by law, we disclaim implied warranties including merchantability, fitness for a particular purpose, title and non-infringement.
Nothing in these Terms excludes warranties, guarantees or consumer rights that cannot legally be excluded.
20. Limitation of Liability
To the maximum extent permitted by law, AfricanDrama Vault and its owners, officers, employees, contractors, affiliates, licensors, suppliers and service providers will not be liable for indirect, incidental, special, punitive, exemplary or consequential damages, including loss of profits, revenue, data, business opportunities, goodwill or anticipated savings.
To the maximum extent permitted by law, our total aggregate liability arising from or relating to the website, an order, a product or these Terms will not exceed the amount you paid to AfricanDrama Vault for the specific product or transaction giving rise to the claim.
These limitations apply regardless of the legal theory asserted and even if we were advised that damage was possible. They do not apply where liability cannot legally be limited or excluded.
21. Indemnification
To the extent permitted by law, you agree to defend, indemnify and hold harmless AfricanDrama Vault and its owners, affiliates, employees, contractors, licensors and service providers from claims, losses, liabilities, damages, judgments and reasonable costs arising from:
- Your violation of these Terms;
- Your unlawful or unauthorized use of the services;
- Your violation of another party’s rights;
- Content or materials you submit;
- Your misuse or redistribution of a digital product.
22. Suspension and Termination
We may suspend, restrict or terminate your access to all or part of the website or services if we reasonably believe you have violated these Terms, engaged in fraud or misuse, created legal or security risk, or harmed AfricanDrama Vault, our customers or another party.
Obligations and rights that by their nature should survive termination—including payment obligations, intellectual-property provisions, disclaimers, liability limitations and indemnification— will remain effective after termination.
23. Errors, Omissions and Corrections
Website information may occasionally contain typographical errors, inaccuracies or omissions concerning descriptions, pricing, promotions, shipping charges, delivery estimates or availability.
We reserve the right to correct errors, update information or cancel affected orders at any time, including after an order has been submitted, subject to applicable law.
24. Events Outside Our Control
We are not responsible for delay or failure caused by circumstances outside our reasonable control, including natural disasters, severe weather, carrier interruptions, labor disputes, supply shortages, production disruptions, internet outages, cyber incidents, governmental actions, public-health emergencies or international shipping restrictions.
25. Electronic Communications
When you visit the website, place an order or communicate with us electronically, you consent to receive transactional communications electronically, including order confirmations, receipts, download instructions, shipping updates and customer-service messages.
Marketing communications are governed by applicable consent and unsubscribe requirements. You may unsubscribe from promotional email by using the unsubscribe option provided in the message.
26. Governing Law and Dispute Resolution
These Terms and any dispute arising from them will be governed by the laws of the United States and the laws of the State of FLORIDA, without regard to conflict-of-law rules, except where mandatory consumer law requires otherwise.
Before filing a formal legal claim, you agree to contact us and make a reasonable good-faith effort to resolve the dispute informally. Send a written explanation of the concern, the applicable order number and the requested resolution to contact@africandramavault.com .
If a dispute cannot be resolved informally, it may be brought in a court with lawful jurisdiction, subject to any consumer rights that apply in your place of residence.
27. Severability, Waiver and Entire Agreement
If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be enforced to the maximum extent permitted or severed, and the remaining provisions will continue in effect.
Our failure to enforce a provision does not waive our right to enforce it later.
These Terms and the policies incorporated by reference constitute the entire agreement between you and AfricanDrama Vault regarding the website, services and purchases, replacing prior communications concerning the same subject.
28. Changes to These Terms
We may revise these Terms to reflect changes in our services, products, business practices, technology or legal obligations.
The updated version will be posted on this page with a revised effective or “last updated” date. Changes become effective when posted unless a different effective date is stated.
Your continued use of the website after updated Terms take effect constitutes acceptance of those changes to the extent permitted by law.
